When you use our Services you agree to all of these terms. Your use of our Services is also subject to Expandigo Cookie Policy and Data Protection Policy, which covers how we collect, use, share, and store your personal information.
You agree that by clicking “Sign in”, “Sign Up”, “Join Now”, “Join Expandigo”, “Log in” or similar, registering, accessing or using our services (described below), you are agreeing to enter into a legally binding agreement with Expandigo. If you do not agree to this agreement (“Agreement” or “Terms of Service”), do not click “Sign in”, “Sign up” (or similar) and do not access or otherwise use any of our Services. If you wish to terminate this agreement, at any time you can do so by closing your account and no longer accessing or using our Services.
This agreement applies to Expandigo.com, Expandigo-branded apps, and other Expandigo-related sites, apps, communications and other services that state that they are offered under this agreement (“Services”), including the offsite collection of data for those Services, such as our ads. Registered users of our Services are “Members” and unregistered users are “Visitors”.
This Agreement applies to “Members” and “Visitors” . When you register and join Expandigo Services, you become a Member. If you have chosen not to register for our Services, you may access certain features as a “Visitor.” As a “Member” or “Visitor” of our Services, the collection, use and sharing of your personal data is subject to Our Terms of Services, Data Protection Policy, which includes our Cookie policy, and updates.
We may modify this Agreement, our Data Protection Policy and our Cookies Policies from time to time. If we make material changes to it, we will provide you notice through our Services, or by other means, to provide you the opportunity to review the changes before they become effective. We agree that changes cannot be retroactive. If you object to any changes, you can close your account. Your continued use of our Services after we publish or send a notice about our changes to these terms means that you are consenting to the updated terms.
To use most of the Services, you must first create an account (“Account”). You agree to provide us with truthfully, accurate, complete and updated information for your Account. In addition, you agree to: (1) use a strong password and keep it confidential; (2) not transfer any part of your account and (3) follow the law and our list of Dos and Don’ts. You are responsible for anything that happens through your account unless you close it or report misuse.We may need to use this information to contact you. We have the right to suspend your account if we find that you have provided false information and you do not correct it, within five (“5”) working days, after we notify you. If you do not comply with our request within the time indicated above, we have the right to close your account.
It is your obligation to safeguard your Account(s) and make sure others do not have access to your Account(s) or password(s). You are solely responsible for any activities on your Account(s) and for maintaining the confidentiality and security of your password(s). Expandigo cannot be liable for any acts or omissions by you in connection with your Account(s). You must immediately notify us if you know or have any reason to suspect that your Account(s) or password(s) have been stolen, misappropriated or compromised or in case of any actual or suspected unauthorized use of your Account(s).
Members and visitors cannot: (i) resell, sublicense, distribute or otherwise provide access to the Services, or data or information contained in or derived from the Services, to any third party; (ii) copy, modify, adapt, translate, prepare derivative works from, reverse engineer, disassemble, or decompile the Services or otherwise attempt to discover any source code or trade secrets related to the Services; or (iii) use the trademarks, trade names, service marks, logos, domain names and other distinctive brand features or any copyright or other proprietary rights associated with the Services for any purpose without the express written consent of Expandigo.
By adding your user’s information on our portal you give us permission to use it in ways necessary to provide, improve, promote and protect our services. Users of the Services may provide Expandigo with content, including without limitation text, photos, images, audio, video, and any other materials (“Content”). Your Content belongs to you, but you provide us with the rights that enable us to provide, improve, promote and protect our Services.
You will honor your payment obligations and you understand that there may be fees and taxes that are added to our prices. If you buy any of our paid Services, you agree to pay us the applicable fees and taxes. Failure to pay these fees will result in the termination of your paid Services. Also, you agree that: Your purchase may be subject to foreign exchange fees or differences in prices based on location (e.g. exchange rates). We may calculate taxes payable by you based on the billing information that you provide us at the time of purchase.
We may change our fees at any time. We will provide you with advance notice of these fee changes via the Services.
If you contact your bank or credit card company to decline, chargeback or otherwise reverse the charge of any payable fees to us (“Chargeback”), we may automatically terminate your Account. If you have questions about a payment made to us, you should immediately contact us before filing a Chargeback. We reserve our right to dispute any Chargeback.
We use a third party payment processor (the “Payment Processor”) to bill you through a payment account linked to your Account. The processing of payments will be subject to the terms, conditions and privacy policies of the Payment Processor, in addition to this Agreement. Our current Payment Processor is Stripe Inc., and your payments are processed by Stripe Inc. in accordance with its terms of service and privacy policy. You agree to pay us, through the Payment Processor, all charges at the prices then in effect for any purchase in accordance with the applicable payment terms. You agree to make payment using the payment method you provide with your Account. We reserve the right to correct, or to instruct our Payment Processor to correct any errors or mistakes, even if payment has already been requested or received.
You agree that we will provide notices and messages to you in the following ways: (1) within the Service, or (2) sent to the contact information you provided us (e.g., email, mobile number, physical address). You agree to keep your contact information up to date.
We may change, suspend or end any Service, or change and modify prices prospectively at our discretion. To the extent allowed under the law, these changes may be effective upon notice provided to you.
You are responsible for deciding if you want to access or use third-party apps or sites that link from our Services. If you allow a third-party app or site to authenticate you or connect with your Expandigo account, that app or site can access information on Expandigo related to you and your connections. Third-party apps and sites have their own legal terms and privacy policies, and you may be giving others permission to use your information in ways we would not. Except to the limited extent it may be required by applicable law, Expandigo is not responsible for these other sites and apps. Please check our Data Protection Policy.
Expandigo reserves all of its intellectual property rights in the Services. Using the Services does not give you any ownership in our Services or the content or information made available through our Services. Trademarks and logos used in connection with the Services are the trademarks of their respective owners. Expandigo, logos and other Expandigo trademarks, service marks, graphics, and logos used for our Services are trademarks or registered trademarks of Expandigo.
To the fullest extent permitted by applicable law, Expandigo makes no warranties, either express or implied, about the Services. The Services are provided “as is” and “as available”. Expandigo makes no warranty or representation that the Services will: (a) be timely, uninterrupted or error-free; (b) meet your requirements or expectations; or (c) be free from viruses or other harmful components. However, Expanding will provide the Services with reasonable care. Some laws do not allow certain disclaimers, so some or all of these disclaimers may not apply to you.
Expandigo reserves the right to limit, restrict, suspend your use of the Services, including the number of your connections and your ability to contact other Members and use of the additional Services and terminate your account if Expandigo believes that you may be in breach of this Agreement or law or are misusing the Services.
To the extent permitted under law (and unless Expandigo has entered into a separate written agreement that overrides this agreement), Expandigo and its affiliates (and those that Expandigo works with to provide the services) shall not be liable to you or others for any indirect, incidental, special, consequential or punitive damages, or any loss of data, opportunities, reputation, profits or revenues, related to the services (e.g. offensive or defamatory statements, down time or loss, use of, or changes to, your information or content). In no event shall the liability of Expandigo and its affiliates (and those that Expandigo works with to provide the services) exceed, in the aggregate for all claims, an amount that is the lesser of (a) five times the most recent monthly or yearly fee that you paid for a paid service, if any, or b) a maximum of US$1,000. This limitation of liability is part of the basis of the bargain between you and Expandigo and shall apply to all claims of liability (e.g. warranty, tort, negligence, agreement, law) and even if Expandigo or its affiliates has been told of the possibility of any such damage, and even if these remedies fail their essential purpose. Some laws do not allow the limitation or exclusion of liability, so these limits may not apply to you.
You agree to contact us and try to work informally with us first to resolve any issues. All disputes must be resolved according to the rules described below. Claims can only be introduced to our attention individually and not as part of a class action. Before filing a claim against Expandigo, you agree to try to resolve the dispute by first emailing [email protected] with a description of your claim. We will try to resolve the dispute informally by following up via email, phone or other methods. If we can’t resolve the dispute within thirty (30) days of our receipt of your first email, you or Expandigo may then introduce a formal proceeding.
You and Expandigo agree that the laws of the Commonwealth of Kentucky, U.S.A., excluding its conflict of laws rules, shall exclusively govern any dispute relating to this Agreement and/or the Services. You and Expandigo both agree that all claims and disputes can be litigated only in the federal or state courts in Jefferson County, Kentucky, USA.
